Domestic Violence Defense Attorney San DiegoA case is labeled a “domestic violence” case when there is an allegation of an assault and/or battery between two people who were previously involved in a romantic relationship, are currently involved in a romantic relationship, or share a child. These cases can be charged as either misdemeanors or felonies depending upon the seriousness of the injury, the history of violence in the relationship, and the criminal record of the defendant.

San Diego Domestic violence allegations are quite serious and can really tear a family apart. Once charges are filed, the Court will issue a protective order restricting contact between the accused and the accuser. I have represented several defendants and seen many other cases where hiring an experienced criminal defense attorney immediately after arrest made a remarkable difference in the resolution of the case. This includes whether or not charges were actually filed in court.

A conviction for a misdemeanor domestic violence charge will result in probation, possible jail time (up to one year) and mandatory domestic violence or anger management counseling.

A conviction for a felony domestic violence charge in San Diego can result in either probation with possible jail time (up to one year) and counseling, or a commitment to state prison.

In most misdemeanor cases, a retained defense attorney can appear in a San Diego court in place of the client, thereby not disrupting the client’s daily routine. Domestic violence cases are an exception to this rule. Defendants in domestic violence cases are required to be personally present for the arraignment and the sentencing on a domestic violence matter. The attorney can, however, appear in the client’s place for all court hearings other than the arraignment and sentencing.
